YACHT CHARTER - RENTAL TERMS


Below is a summary of the general terms and conditions.
The full version of the terms and conditions can be found in the respective charter agreements.


CONDITIONS FOR SAILING AND YACHT RENTAL
WITH CREW (CREWED CHARTER):
WITHOUT CREW (BAREBOAT):
ACCOMMODATION ON BOARD WITHOUT SAILING:


Validity and Reservation Confirmation

- The rental price is determined at the time of booking.
- A deposit is required to confirm the reservation.
- The reservation is valid upon payment of a deposit equal to 30% of the rental price.
- The balance must be paid no later than 14 days before embarkation – cashless.
- For bookings made less than 14 days before the start date, full payment is required immediately upon booking.
- After payment of the reservation deposit, the customer will receive a reservation confirmation via email.
- Payments are made via QR code, card, or bank transfer.
- Prices are stated in EUR (euro) and include insurance.
- Insurance does not cover damages caused outside the agreement.
- The meeting place and time will be stated in the contract.


Cancellation and Reservation Changes

- Cancellations or changes must be made in writing (by email).

- Changes to the reservation for another date are possible only by agreement, subject to availability.

- Cancellation fees: >30 days – 0%, 20 days – 50%, <14 days – 100%
- If we have available dates, we will gladly accommodate you and offer a suitable alternative.


General Provisions for All Charters

- The client is responsible for the behavior of all persons on board.
- Smoking and the use of narcotics on board are prohibited.
- The client acknowledges that standard insurance may not cover all damages or losses

caused by negligent handling and agrees to compensate for damages beyond insurance coverage.
- The operator cannot and does not take responsibility for the loss or damage of personal belongings of the client or their companions.




1. CREWED CHARTER TERMS (CREWED CHARTER)

Safety and Responsibility

- The meeting place and time are stated in the contract.
- The crew is provided by the operator.
- The client must follow the instructions of the captain and crew related to safety, health protection, and proper use of the vessel.
- The client is responsible for any damages resulting from violation of crew

instructions or unauthorized handling of the yacht or its equipment.
- The client is responsible for the behavior of all persons on board.
- Smoking and the use of narcotics on board are prohibited.
- The client and passengers may not interfere with the operation of the yacht or its technical equipment

without the explicit consent of the captain.
- In case of violation of these rules, the captain has the right to terminate the charter without refund.
- The client acknowledges that standard insurance may not cover all damages or losses caused by negligent handling

and agrees to compensate for damages beyond insurance coverage.
- The operator cannot and does not take responsibility for the loss or damage of personal belongings of the client or their companions.
- Clients will always be returned to the same place from which they departed with the crew.


Adverse Weather and Sailing Safety

- In case of adverse weather conditions or other circumstances that may endanger the safety of persons or the yacht,

the operator (or captain) is entitled to postpone, shorten, alter the route, or completely cancel the charter.

This decision is binding and cannot be disputed by the client.
- If the charter is canceled before it begins, the client will be offered an alternative date. If no alternative is possible,

the client is entitled to a refund.
- If the charter is interrupted or altered during the course due to force majeure

(adverse weather, technical failure not caused by the operator, etc.), the client is not entitled to financial compensation

if an appropriate alternative service is provided (e.g., anchoring, stay on board in port, or alternative program).




2. BAREBOAT CHARTER (WITHOUT CREW)


Age and Qualifications:

- The captain must provide a valid license recognized by Spanish authorities.
- The minimum age of the captain must be over 25 years.
- Proof of at least 2 years of experience as a skipper is required.
- Without the required documentation, the yacht will not be handed over, and the client has no right to a refund.


Yacht Handover to the Renter

- The place and time of handover are stated in the contract.
- The yacht is handed over with full equipment and must be returned in the same condition.
- The yacht is delivered clean, with a full fuel tank, and in a technically seaworthy condition.
- The yacht has valid statutory insurance for commercial purposes.
- The renter must check the yacht at handover and sign the handover protocol.
- Upon handover, the renter must pay a security deposit and deductible as stated in the rental agreement.

The deposit serves as a guarantee for compliance with terms, and the deductible is payable in case of damage.

Both payments are made by card.
- The yacht must be returned clean, with a full fuel tank, and in technically seaworthy condition – in the same state as at handover.
- The yacht must be returned at the agreed time and location stated in the contract.


Safety and Client Responsibility

- The yacht has valid statutory insurance for commercial purposes.
- The renter must comply with all maritime regulations and restrictions (e.g., sailing areas, number of persons on board, safety measures).
- The renter is responsible for all damages to the yacht and port facilities, fines, maritime or port charges incurred

during the rental period, unless covered by agreed insurance.
- The renter is liable for damages caused by gross negligence, improper use, or if unauthorized persons are allowed to operate the yacht.
- Insurance provided by the operator may not cover these situations.
- The renter is responsible for any damages resulting from violation of crew instructions or unauthorized handling of the yacht

or its equipment.
- The renter is responsible for the behavior of all persons on board.
- Smoking, drug use, and open flames are prohibited on board.
- The transport of hazardous materials and participation in illegal activities is prohibited.
- The operator cannot and does not take responsibility for the personal belongings of the client or their companions.
- Insurance does not cover damages such as loss of keys or documents or interior damage.
- Fines incurred during the rental are fully payable by the renter.

In case of a violation, the operator has the right to provide the renter's information to the relevant authorities.
- Violation of all contractual terms and safe-use rules entitles the operator to immediate termination of the rental

and repossession of the yacht.
- All conditions are stated in the contract and are binding.


Handover and Return of the Yacht

- If you have difficulties returning at the agreed time and it is within our possibilities to accommodate you,

we may adjust the return time stated in the contract for that day.
- The yacht must be returned at the agreed time and location stated in the contract.
- Unless otherwise agreed in writing, handover follows the conditions in the contract.
- All changes to time or place must be confirmed in writing (email, SMS, or other agreed communication).
- Late returns are charged unless agreed in writing by both parties.
- If no alternative place or later return is agreed in writing, a fee of €150 per hour started will apply.
- In case of adverse weather or other circumstances endangering safety, this fee will not apply.
- The yacht must be returned clean, with a full fuel tank, and in technically seaworthy condition – in the same state as at handover.
- The yacht must be returned at the agreed time and location stated in the contract.
- All additional fees for damage, dirt, or other breaches of rental conditions are stated in the rental agreement.


Adverse Weather and Sailing Safety

- The client acknowledges that sailing safety is their responsibility as captain. The operator provides a technically seaworthy yacht.
- In case of adverse weather or other circumstances endangering safety, the client must consider postponing the trip

and respect official warnings issued by authorities or meteorological services.
- The operator is not responsible for the client's decision to sail in unsafe conditions.
- In case of cancellation due to adverse weather: If cancellation occurs before the rental period begins,

the renter is entitled to a refund or agreement on an alternative date.
- If the client sets sail and subsequently ends or shortens the trip for safety reasons,

the operator is not responsible for any financial compensation.




3. ACCOMMODATION ON BOARD WITHOUT SAILING


Safety and Responsibility

- In this case, the yacht is used exclusively as accommodation moored in the port/marina.
- The yacht is used only for accommodation, without the possibility of sailing.
- The renter is responsible for damages caused on the yacht, its equipment,

or the marina area due to their actions or the actions of persons they allow on board.
- Manipulating the yacht’s technical equipment (engine, navigation, electrical systems) is prohibited.
- The renter and their companions must comply with port rules, including quiet hours, safety, and order.

Violation may lead to immediate termination of the stay without compensation.
- Smoking, drug use, and open flames are prohibited on board.
- The operator cannot and does not take responsibility for personal belongings of the client or their companions.


OTHER PROVISIONS OF THE TERMS:


Governing Law and Language

- All legal relations between the service provider and the client are governed by the laws of the Kingdom of Spain.

Any disputes will be resolved by the courts competent for the provider’s registered office.
- These terms are available in multiple languages (Spanish, English, German, Czech).

In case of differing interpretations, the Spanish version is legally binding.
- For all communications related to these terms and their business, the provider may use their preferred language.

For maximum protection, the provider may use Czech.
- If an official or judicial translation into Spanish is required, it will be arranged. Costs of the translation are borne by each party individually.


Data Protection

- The personal data of the renter will be processed in accordance with applicable data protection laws.
- The renter agrees to the processing of their personal data for the purposes of fulfilling this contract.
